Australian terms and subscription conditions
These conditions apply when TRP is supplied by Netwerkers B.V. to a customer whose billing country is Australia.
Supplier and support
TRP is supplied by Netwerkers B.V., Olaertsduynstraat 13, 2665 HK Bleiswijk, the Netherlands, Dutch Chamber of Commerce number 92664466. Support: info@trpforme.com.
Nature and intended purpose of TRP
TRP is a neutral digital control and presentation tool for trained professionals. It enables a professional to configure and remotely present visual and/or auditory bilateral stimuli during an agreed live session. TRP does not diagnose, prevent, monitor, predict, prognose, treat or alleviate a disease or injury; it does not recommend a treatment, interpret patient data, measure outcomes or make patient-specific decisions.
The professional independently decides whether, how, where and for which professional activity TRP is used. TRP does not replace professional judgement, qualifications, informed consent, clinical monitoring, emergency arrangements or any treatment protocol.
Plans, price and recurring payment
Basic costs AUD 21.00 per therapist account per month and provides the website version and secure client link. Premium costs AUD 25.00 per therapist account per month and additionally provides integrations for Google Meet, Microsoft Teams and Zoom. Netwerkers B.V. is currently below the Australian compulsory GST-registration threshold and is not charging Australian GST. The checkout therefore shows the full amount as the subscription price and GST as not charged.
The subscription starts after successful payment and renews automatically every month until cancelled. The checkout identifies the selected plan, final monthly amount, tax treatment and payment method before the customer confirms. Customers can cancel online under Manage subscription. Cancellation stops future renewals; access normally continues until the end of the paid period.
Australian GST and business declarations
Australian consumer turnover is monitored against the compulsory GST-registration threshold. Netwerkers B.V. will register and update the checkout and invoices before charging Australian GST. Until that registration is active, no amount is represented as Australian GST and no Australian GST registration number is shown.
An Australian business may provide a valid eleven-digit Australian Business Number and declare that TRP is acquired solely for use in its enterprise. Mollie processes the payment in AUD. TRP does not receive complete card or bank details.
Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these conditions excludes, restricts or modifies a non-excludable consumer guarantee, remedy or other statutory right. Depending on the circumstances, available remedies may include correction of the service, cancellation, a price reduction or refund.
A customer-initiated online subscription does not have a general statutory cooling-off period merely because it was bought online. This does not affect remedies for a failure to comply with a consumer guarantee. TRP does not apply a blanket no-refunds rule.
Professional responsibility and safety
The professional is responsible for qualifications, competence, suitability, informed consent, contraindications, monitoring, stop arrangements, records, confidentiality, emergency procedures and the treatment or other professional activity in which TRP is used. Clients must remain in contact with the responsible professional. TRP is not an emergency or crisis service.
Privacy and acceptable use
Do not enter client names, diagnoses, treatment notes, recordings or other health information into TRP account, technical or support fields. The Australian privacy statement explains account, payment and security processing. The customer must use TRP lawfully and must not test, circumvent or interfere with security controls.
Availability and liability
TRP depends on internet, device and third-party platform availability. Netwerkers B.V. works to provide a reliable service but does not promise uninterrupted operation of Google, Microsoft, Zoom, internet or customer equipment. Any limitation of liability applies only to the maximum extent permitted by law and does not limit rights that cannot lawfully be excluded under the Australian Consumer Law.
Governing law and complaints
Dutch law applies to the contract to the extent permitted, but this choice does not deprive an Australian consumer of mandatory protections that apply under Australian law. Questions, complaints and requests for an Australian Consumer Law remedy can be sent to info@trpforme.com.
